If you are making a reservation for one or more travellers other than yourself, you must confirm and represent that each of these other travelers have agreed, in advance, that you may disclose their Personal Information to us.

Member Registration: If you choose to become a registered member of Website, you must provide your name, address, telephone number, e-mail address, a unique login name, password, and password validation, and a password hint to help you remember your password. This information is collected on the registration form for several reasons including but not limited to: Personal identification, To complete air, hotel, car, and other reservations, To allow us to contact you for customer service purposes, if necessary, To customize the content of our site to strive to meet your specific needs; and/or, To make product or other improvements to our site. For example, you can store your airline frequent – flyer numbers so that when your make a reservation on that airline, we may automatically pre – fill the frequent – flyer number input box for you.

Online Surveys: WHITE COLLAR TOURS AND TRAVELS values opinions and comments from members, so we frequently conduct online surveys. Participation in these surveys is entirely optional. Typically, the information is aggregated, and used to make improvements to the Website and its services and to develop appealing content, features and promotions for Website members. Survey participants are anonymous unless otherwise stated in the survey.

Promotions & Sweepstakes: WHITE COLLAR TOURS AND TRAVELS frequently sponsors promotions and sweepstakes to give Website members the opportunity to win great travel and travel – related prizes. However, we do not sell or rent individual customer names or other Personal Information to third parties except sharing of such information with our alliance partners or vendors who are engaged by us for providing various promotional and other benefits to our customers from time to time basis their booking history with us. We use non – personally identifiable information in aggregate form to build higher quality, more useful online services by performing statistical analysis of the collective characteristics and behavior of our customers and visitors, and by measuring demographics and interests regarding specific areas of the Website. We may provide anonymous statistical information based on this data to suppliers, advertisers, affiliates and other current and potential Business partners. User Agreement

APPLICABILITY OF THE AGREEMENT: This agreement (“user agreement”) incorporates the terms and conditions for WHITE COLLAR TOURS AND TRAVELS to provide services to the person (s) (“the User”) intending to purchase or inquiring for any products and/ or services of WHITE COLLAR TOURS AND TRAVELS by using WHITE COLLAR TOURS & TRAVELS"s websites or using any other customer interface channels of WHITE COLLAR TOURS AND TRAVELS which includes its sales persons, offices, call centers, advertisements, information campaigns etc. Both User and WHITE COLLAR TOURS AND TRAVELS are individually referred as „party" to the agreement and collective referred to as „parties".

USER’S RESPONSIBILITY OF COGNIZANCE OF THIS AGREEMENT: The Users availing services from WHITE COLLAR TOURS AND TRAVELS shall be deemed to have read, understood and expressly accepted the terms and conditions of this agreement, which shall govern the desired transaction or provision of such services by WHITE COLLAR TOURS AND TRAVELS for all purposes, and shall be binding on the User. All rights and liabilities of the User and/or WHITE COLLAR TOURS AND TRAVELS with respect to any services to be provided by WHITE COLLAR TOURS AND TRAVELS shall be restricted to the scope of this agreement. WHITE COLLAR TOURS AND TRAVELS reserves the right, in its sole discretion, to terminate the access to any or all WHITE COLLAR TOURS AND TRAVELS websites or its other sales channels and the related services or any portion thereof at any time, without notice, for general maintenance or any reason what so ever. In addition to this Agreement, there are certain terms of service (TOS) specific to the services rendered/ products provided by WHITE COLLAR TOURS AND TRAVELS like the air tickets, MICE, bus, rail, holiday packages etc. Such TOS will be provided/ updated by WHITE COLLAR TOURS AND TRAVELS which shall be deemed to be a part of this Agreement and in the event of a conflict between such TOS and this Agreement, the terms of this Agreement shall prevail. The User shall be required to read and accept the relevant TOS for the service/ product availed by the User. Additionally, the Service Provider itself may provide terms and guidelines that govern particular features, offers or the operating rules and policies applicable to each Service (for example, flights, hotel reservations, packages, etc.). The User shall be responsible for ensuring compliance with the terms and guidelines or operating rules  and policies of the Service Provider with whom the User elects to deal, including terms and conditions set forth in a Service Providers" fare rules, contract of carriage or other rules. WHITE COLLAR TOURS & TRAVELS"s Services are offered to the User conditioned on acceptance without modification of all the terms, conditions and notices contained in this Agreement and the TOS, as may be applicable from time to time. For the removal of doubts, it is clarified that availing of the Services by the User constitutes an acknowledgement and acceptance by the User of this Agreement and the TOS. If the User does not agree with any part of such terms, conditions and notices, the User must not avail WHITE COLLAR TOURS & TRAVELS"s Services. In the event that any of the terms, conditions, and notices contained herein conflict with the Additional Terms or other terms and guidelines contained within any other WHITE COLLAR TOURS AND TRAVELS document, then these terms shall control.

THIRD PARTY ACCOUNT INFORMATION: By using the Account Access service in WHITE COLLAR TOURS & TRAVELS"s websites, the User authorizes WHITE COLLAR TOURS AND TRAVELS and its agents to access third party sites, including that of Banks and other payment gateways, designated by them or on their behalf for retrieving requested information. While registering, the User will choose a password and is responsible for maintaining the confidentiality of the password and the account. The User is fully responsible for all activities that occur while using their password or account. It is the duty of the User to notify WHITE COLLAR TOURS AND TRAVELS immediately in writing of any unauthorized use of their password or account or any other breach of security. WHITE COLLAR TOURS AND TRAVELS will not be liable for any loss that may be incurred by the User as a result of unauthorized use of his password or account, either with or without his knowledge. The User shall not use anyone else’s password at any time

FEES AND PAYMENT: In addition to the cost of booking as charged by the Service Providers, WHITE COLLAR TOURS AND TRAVELS reserves the right to charge certain fees in the nature of convenience fees or service fees. WHITE COLLAR TOURS AND TRAVELS further reserves the right to alter any and all fees from time to time. Any such additional fees, including fee towards any modifications thereof, will be displayed to the User before confirming the booking or collecting the payment from such User.

In cases of short charging of the booking amount, taxes, statutory fee, convenience fee etc., owing to any technical error or other reason, WHITE COLLAR TOURS AND TRAVELS shall reserve the right to deduct, charge or claim the balance amount from the User and the User shall pay such balance amount to WHITE COLLAR TOURS AND TRAVELS. In cases where the short charge is claimed prior to the utilization of the booking, WHITE COLLAR TOURS AND TRAVELS will be at liberty to cancel such bookings if the amount is not paid before the utilization date.

Any increase in the price charged by WHITE COLLAR TOURS AND TRAVELS on account of change in rate of taxes or imposition of new taxes, levies by Government shall have to be borne by the User. Such imposition of taxes, levies may be without prior notice and could also be retrospective but will always be as per applicable law.

In the rare circumstance of a booking not getting confirmed for any reason whatsoever, WHITE COLLAR TOURS AND TRAVELS will process the refund of the booking amount paid by the User and intimate the User about the same. WHITE COLLAR TOURS AND TRAVELS is not under any obligation to provide an alternate booking in lieu of or to compensate or replace the unconfirmed booking. All subsequent bookings will be treated as new transactions. Any applicable refund will be processed as per the defined policies of the service provider and WHITE COLLAR TOURS AND TRAVELS as the case may be.

The User shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the service, as per the applicable laws

The User agrees and understands that all payments shall only be made to bank accounts of WHITE COLLAR TOURS AND TRAVELS. WHITE COLLAR TOURS AND TRAVELS or its agents, representatives or employees shall never ask a customer to transfer money to any private account or to an account not held in the name of WHITE COLLAR TOURS AND TRAVELS. The User agrees that if that user transfers any amount against any booking or transaction to any bank account that is not legitimately held by WHITE COLLAR TOURS AND TRAVELS or to any personal account of any person, WHITE COLLAR TOURS AND TRAVELS shall not be held liable for the same. User shall not hold any right to recover from WHITE COLLAR TOURS AND TRAVELS any amount which is transferred by the User to any third party.

The User will not share his personal sensitive information like credit/debit card number, CVV, OTP, card expiry date, user IDs, passwords etc. with any person including the agents, employees or representatives of WHITE COLLAR TOURS AND TRAVELS. The User shall immediately inform WHITE COLLAR TOURS AND TRAVELS if such details are demanded by any of its agents' employees or representatives. WHITE COLLAR TOURS AND TRAVELS shall not be liable for any loss that the User incurs for sharing the aforesaid details.

Refunds, if any, on cancelled bookings will always be processed to the respective account or the banking instrument (credit card, wallet etc.) from which payment was made for that booking.

Booking(s) made by the User through WHITE COLLAR TOURS AND TRAVELS are subject to the applicable cancellation policy as set out on the booking page or as communicated to the customers in writing.

WHITE COLLAR TOURS AND TRAVELS provides various modes of making payments on the Website for transacting, like UPI, Credit/Debit Cards of various banks, Net Banking facility of all major banks, WHITE COLLAR TOURS AND TRAVELS and third party Wallets, Gift Cards, EMI and more.

USAGE OF THE MOBILE NUMBER OF THE USER BY WHITE COLLAR TOURS & TRAVELS: WHITE COLLAR TOURS AND TRAVELS may send booking confirmation, itinerary information, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction, via SMS or by voice call on the contact number given by the User at the time of booking; WHITE COLLAR TOURS AND TRAVELS may also contact the User by voice call, SMS or email in case the User couldn't or hasn't concluded the booking, for any reason what so ever, to know the preference of the User for concluding the booking and also to help the User for the same. The User hereby unconditionally consents that such communications via SMS and/ or voice call by WHITE COLLAR TOURS AND TRAVELS is (a) upon the request and authorization of the User, (b) transactional and not an unsolicited commercial communicational as per the guidelines of Telecom Regulation Authority of India (TRAI) and (c) in compliance with the relevant guidelines of TRAI or such other authority in India and abroad. The User will indemnify WHITE COLLAR TOURS AND TRAVELS against all types of losses and damages incurred by WHITE COLLAR TOURS AND TRAVELS due to any action taken by TRAI, Access Providers (as per TRAI regulations) or any other authority due to any erroneous compliant raised by the User on WHITE COLLAR TOURS AND TRAVELS with respect to the intimations mentioned above or due to a wrong number or email id being provided by the User for any reason whatsoever.

ONUS OF THE USER: WHITE COLLAR TOURS AND TRAVELS is responsible only for the transactions that are done by the User through WHITE COLLAR TOURS & TRAVELS. WHITE COLLAR TOURS AND TRAVELS will not be responsible for screening, censoring or otherwise controlling transactions, including whether the transaction is legal and valid as per the laws of the land of the User. The User warrants that they will abide by all such additional procedures and guidelines, as modified from time to time, in connection with the use of the services. The User further warrants that they will comply with all applicable laws and regulations regarding use of the services with respect to the jurisdiction concerned for each transaction. The User represent and confirm that the User is of legal age to enter into a binding contract and is not a person barred from availing the Services under the laws of India or other applicable law.

ADVERTISERS ON WHITE COLLAR TOURS AND TRAVELS OR LINKED WEBSITES: WHITE COLLAR TOURS AND TRAVELS is not responsible for any errors, omissions, or representations on any of its pages or on any links or on any of the linked website pages. WHITE COLLAR TOURS AND TRAVELS does not endorse any advertiser on its web pages in any manner. The Users are requested to verify the accuracy of all information on their own before undertaking any reliance on such information. INSURANCE: Unless explicitly provided by WHITE COLLAR TOURS AND TRAVELS in any specific service or deliverable, obtaining sufficient insurance coverage is the obligation/option of the user and WHITE COLLAR TOURS AND TRAVELS doesn’t accept any claims arising out of

such scenarios. Insurance, if any provided as a part of the service/ product by WHITE COLLAR TOURS AND TRAVELS shall be as per the terms and conditions of the insurance company. The User shall contact the insurance company directly for any claims or disputes and WHITE COLLAR TOURS AND TRAVELS shall not provide any express or implied undertakings for acceptance of the claims by the insurance company.

FORCE MAJURE CIRCUMSTANCES: The user agrees that there can be exceptional circumstances where the service operators like the airlines, hotels, the respective transportation providers or concerns may be unable to honor the confirmed bookings due to various reasons like climatic conditions, labor unrest, insolvency, business exigencies, government decisions, operational and technical issues, route and flight cancellations etc. If WHITE COLLAR TOURS AND TRAVELS is informed in advance of such situations where dishonor of bookings may happen, it will make its best efforts to provide similar alternative to its customers or refund the booking amount after reasonable service charges, if supported and refunded by that respective service operators. The user agrees that WHITE COLLAR TOURS AND TRAVELS being an agent for facilitating the booking services shall not be responsible for any such circumstances and the customers have to contact that service provider directly for any further resolutions and refunds. Customer acknowledges that WHITE COLLAR TOURS AND TRAVELS is only a facilitator and any refund for any service(s) which was/were not delivered by the service provider or for any reason for which the User is entitled for a refund is subject to WHITE COLLAR TOURS AND TRAVELS receiving the amount from the said service provider. User acknowledges that WHITE COLLAR TOURS AND TRAVELS shall not be held liable for any delay in refund or non-refund of the amount from the service provider. In such events the User shall directly approach the service provider for any claims. The User agrees that in situations due to any technical or other failure in WHITE COLLAR TOURS & TRAVELS, services committed earlier may not be provided or may involve substantial modification. In such cases, WHITE COLLAR TOURS AND TRAVELS shall refund the entire amount received from the customer for availing such services minus the applicable cancellation, refund or other charges, which shall completely discharge any and all liabilities of WHITE COLLAR TOURS AND TRAVELS against such non-provision of services or deficiencies. WHITE COLLAR TOURS AND TRAVELS shall not be held liable for any incidental loss or damage that may arise from the bookings made by any person through such Travel Agents. The liability in case of such cancellations shall be solely borne by such Travel Agents.

LIMITED LIABILITY OF WHITE COLLAR TOURS AND TRAVELS

Unless explicitly committed by WHITE COLLAR TOURS AND TRAVELS as a part of any product or service:

WHITE COLLAR TOURS AND TRAVELS may also contact the User through the modes mentioned above for any pending or failed bookings, to know the preference of the User for concluding the booking and also to help the User for the same.

The User hereby unconditionally consents that such communications via SMS, internet-based messaging applications like WhatsApp, voice call, email or any other mode by WHITE COLLAR TOURS AND TRAVELS are:

·       upon the request and authorization of the User;

·       'transactional' and not an 'unsolicited commercial communication' as per the guidelines of Telecom Regulation Authority of India (TRAI), and

·       in compliance with the relevant guidelines of TRAI or such other authority in India and abroad.

The User will indemnify WHITE COLLAR TOURS AND TRAVELS against all types of losses and damages incurred by WHITE COLLAR TOURS AND TRAVELS due to any action taken by TRAI, Access Providers (as per TRAI regulations) or any other authority due to any erroneous complaint raised by the User on WHITE COLLAR TOURS AND TRAVELS with respect to the communications mentioned above or due to a wrong number or email id being provided by the User for any reason whatsoever.

FLIGHTS

TERMS OF THE AIRLINES

The airline tickets available through the Website are subject to the terms & conditions of the concerned airline, including but not limited to cancellation and refund policies.

WHITE COLLAR TOURS AND TRAVELS merely acts as a facilitator to enable the User to book a flight ticket. The contract of service for utilization of the flight is always between the User and the concerned airline.

Airlines retain the right to reschedule flight times, route, change or cancel flights or itineraries independent of and without prior intimation to WHITE COLLAR TOURS AND TRAVELS. As a facilitator WHITE COLLAR TOURS AND TRAVELS has no control or authority over the logistics of the airlines and therefore is not liable for any loss, direct or incidental, that a User may incur due to such change or cancellation of a flight.

Different tickets on the same airline may carry different restrictions or include different services and price.

The baggage allowance on given fare is as per the terms decided by the airline, and WHITE COLLAR TOURS AND TRAVELS has no role to play in the same. Some of the fares shown in the booking flow are "hand baggage fares" which do not entitle the User for free check in baggage and therefore the User will be required to pay separately for check in baggage. The prices for adding check-in baggage to a booking may vary from airline to airline. The User is advised to contact the airlines for detailed costs.

CODE SHARE

Some airlines enter into "code share" agreements with other Airlines. This means that on certain routes, the airline carrier selling or marketing the flight ticker does not fly its own aircraft to that destination. Instead, it contracts or partners with another airline to fly to that destination. The partner airline is listed as "operated by" in the booking flow.

If your flight is a code share, it will be disclosed to you in the booking process and prior to payment.

WHITE COLLAR TOURS AND TRAVELS will disclose any such code-share arrangements to the User, only when the ticketing airline discloses it to WHITE COLLAR TOURS AND TRAVELS in the first place.

PRICING

The total price displayed on the Website on the payment page usually includes base fare, applicable government taxes and convenience fee. Users are required to pay the entire amount prior to the confirmation of their booking(s). In the event the User does not pay the entire amount, WHITE COLLAR TOURS AND TRAVELS reserves its right to cancel the booking. User agrees to pay all statutory taxes, surcharges and fees, as applicable on the date of travel.

To avail infant fares, the age of the child must be under 24 months throughout the entire itinerary. This includes both onward and return journeys. If the infant is 24 months or above on the return journey, User will be required to make a separate booking using a child fare. Any infants or children must be accompanied by an adult as per the terms of the airlines.

TRAVEL DOCUMENTS

It shall be the sole responsibility of the User to ensure they are in possession of valid travel documents such as identity proof, passport, visa (including transit visa) etc. to undertake the travel. User agrees that in case of inability to travel for not carrying valid travel documents, WHITE COLLAR TOURS AND TRAVELS shall in no way be held liable.

User understands that the information (if any) provided by WHITE COLLAR TOURS AND TRAVELS regarding the travel documents is only advisory in nature and can't be considered conclusive. The User shall ensure checking the requirements of travel with the respective airlines of the respective jurisdictions the User may transit through or choose to visit.

CHECK-IN TERMS

User should check with the airlines directly regarding the check-in timings. Usually, check-in begins 2 hours before departure for domestic flights, and 3 hours before departure for international flights.

User should carry valid identification proofs, passport, age proofs as may be required to prove the identity, nationality and age of the passengers travelling on a ticket, including infants.

USE OF FLIGHT SEGMENTS

In the event User does not embark on the onward journey, the entire PNR pertaining to that booking shall be automatically cancelled by the airline. In such a scenario WHITE COLLAR TOURS AND TRAVELS has no control in the said process nor will be obligated to provide alternate bookings to the User. The cancellation penalty in such an event shall be as per the applicable airline rules.

CHANGES TO EXISTING BOOKING

Any changes that are made to any existing booking shall be subject to certain charges levied by the respective airline, apart from the service fee charged by WHITE COLLAR TOURS AND TRAVELS.

The User shall be obligated to pay applicable charges in the event of any alteration or modification to an existing booking. However, depending on the airline's policy and fare class, charges for changes or modifications to existing bookings may vary.

REFUND

Refunds will be processed as per the airline fare rules and cancellation policy. Such refunds shall be subject to WHITE COLLAR TOURS AND TRAVELS receiving the same from the airlines. However, the convenience fee paid to WHITE COLLAR TOURS AND TRAVELS paid at the time of booking is a non-refundable fee.

All cancellations made directly with the airline need to be intimated to WHITE COLLAR TOURS AND TRAVELS, in order to initiate the process of refund. The processing time for refunds may vary depending on the mode of payment, bank etc. The refund shall be processed after deducting the WHITE COLLAR TOURS AND TRAVELS service fee which is independent of the convenience fee as mentioned above.

The refund will be credited to the same account from which the payment was made. For example, if the User used a credit card, WHITE COLLAR TOURS AND TRAVELS will make an appropriate charge reversal to the same credit card; like-wise if the User used a debit card, WHITE COLLAR TOURS AND TRAVELS will credit the money to the same debit card.

In the event of cancellation and refund of partially utilized tickets, upfront discount and promo code discount availed at the time of booking would be deducted from the refund amount.

HOTELS

ROLE OF WHITE COLLAR TOURS AND TRAVELS AND LIMITATION OF LIABILITY OF WHITE COLLAR TOURS AND TRAVELS

WHITE COLLAR TOURS AND TRAVELS acts as a facilitator and merely provides an online platform to the User to select and book a particular hotel. Hotels in this context includes all categories of accommodations such as hotels, homestays, bed and breakfast stays, farm-houses and any other alternate accommodations.

All the information pertaining to the hotel including the category of the hotel, images, room type, amenities and facilities available at the hotel are as per the information provided by the hotel to WHITE COLLAR TOURS AND TRAVELS. This information is for reference only. Any discrepancy that may exist between the website pictures and actual settings of the hotel shall be raised by the User with the hotel directly, and shall be resolved between the User and hotel. WHITE COLLAR TOURS AND TRAVELS will have no responsibility in that process of resolution, and shall not take any liability for such discrepancies.

INFORMATION FROM THE HOTEL AND THE TERMS OF THE HOTEL

The hotel booking voucher which WHITE COLLAR TOURS AND TRAVELS issues to a User is solely based on the information provided or updated by the hotel regarding the inventory availability. In no circumstances can WHITE COLLAR TOURS AND TRAVELS be held liable for failure on part of a hotel to accommodate the User with a confirmed booking, the standard of service or any insufficiency in the services, or any other service related issues at the hotel. The liability of WHITE COLLAR TOURS AND TRAVELS in case of denial of check-in by a hotel for any reason what-so-ever including over-booking, system or technical errors, or unavailability of rooms etc., will be limited to either providing a similar alternate accommodation at the discretion of WHITE COLLAR TOURS AND TRAVELS (subject to availability at that time), or refunding the booking amount (to the extent paid) to the User. Any other service related issues should be directly resolved by the User with the hotel.

Hotels reserves the sole right of admission and WHITE COLLAR TOURS AND TRAVELS has no say whatsoever in admission or denial for admission by the hotel. Unmarried or unrelated couples may not be allowed to check-in by some hotels as per their policies. Similarly, accommodation may be denied to guests posing as a couple if suitable proof of identification is not presented at the time check-in. Some hotels may also not allow local residents to check-in as guests. WHITE COLLAR TOURS AND TRAVELS will not be responsible for any check-in denied by the hotel due to the aforesaid reasons or any other reason not under the control of WHITE COLLAR TOURS AND TRAVELS. No refund would be applicable in case the hotel denies check-in under such circumstances.

RESPONSIBILITIES OF THE USER

The User would be liable to make good any damage(s) caused by any act of him/ her/ or their accompanying guests (willful/negligent) to the property of the hotel in any manner whatsoever. The extent and the amount of the damage so caused would be determined by the concerned hotel. WHITE COLLAR TOURS AND TRAVELS would not, in any way, intervene in the same.

The primary guest must be at least 18 years old to be able to check into the hotel.

The User has to be in possession of a valid identity proof and address proof, at the time of check-in. The hotel shall be within its rights to deny check-in to a User if a valid identity proof is not presented at the time of check-in.

Check-in time, check-out time, and any changes in those timings, will be as per hotel policy & terms. Early check-in or late check-out request is subject to availability and the hotel may charge an additional fee for providing such services.

ADDITIONAL CHARGES BY THE HOTEL

The booking amount paid by the User is only for stay at the hotel. Some bookings may include breakfast and/ or meals as confirmed at the time of booking. Any other services utilized by the User at the hotel, including laundry, room service, internet, telephone, extra food, drinks, beverages etc. shall be paid by the User directly to the hotel.

Hotels may charge a mandatory meal surcharge on festive periods like Christmas, New Year's Eve or other festivals as decided by the hotel. All additional charges (including mandatory meal surcharges) need to be cleared directly at the hotel. WHITE COLLAR TOURS AND TRAVELS will have no control over waiving the same.

PAYMENT FOR BOOKINGS AND ANY ADDITIONAL PAYMENTS

Booking of a hotel can either be "Prepaid", or "Pay at hotel" as per the options made available by a hotel on the Website of WHITE COLLAR TOURS AND TRAVELS.

In "Prepaid" model, the total booking amount is paid by the User at the time of booking itself. Such total booking amount includes the hotel reservation rate, taxes, service fees as may be charged on behalf of the actual service provider, and any additional booking fee or convenience fee charged by WHITE COLLAR TOURS AND TRAVELS.

At the hotel's or WHITE COLLAR TOURS AND TRAVELS's sole discretion on case to case basis, the User may also be provided with an option to make a part payment to WHITE COLLAR TOURS AND TRAVELS at the time of confirmation of a booking. The balance booking amount shall be paid as per the terms of the bookings. For security purposes, the User must provide WHITE COLLAR TOURS AND TRAVELS with correct credit or debit card details. WHITE COLLAR TOURS AND TRAVELS may cancel the booking at its sole discretion in case such bank or credit card details as provided by the User are found incorrect.

If a User has any questions about the fees or any exchange rate applied, they may contact their bank or the card issuing company through which payment was made.

Some accommodation suppliers may require User and/or the other persons, on behalf of whom the booking is made, to present a credit card or cash deposit upon check-in to cover additional expenses that may be incurred during their stay. Such deposit is unrelated to any payment received by WHITE COLLAR TOURS AND TRAVELS and solely at the behest of the Hotel.

In "Pay at hotel" model, the concerned hotel will collect the entire payment against the booking at the time of check-in. In case of international bookings, the payment will be charged in local currency or in any other currency, as decided by the hotel. For security purposes, the User must provide WHITE COLLAR TOURS AND TRAVELS with correct credit or debit card details. WHITE COLLAR TOURS AND TRAVELS may cancel the booking at its sole discretion in case such bank or credit card details as provided by the User are found incorrect.

ACTIVITIES AND OTHER SERVICES

DEFINITIONS

'Activity' includes day tours & sightseeing, spa & wellness, adventure sports, cruise, theme/ amusement parks, buffets & dining or any other service/product booked on the Website.

The provider of the Activity will be referred as 'Activity Provider', who shall be solely responsible for provision of the products/ services booked by the User.

ROLE OF WHITE COLLAR TOURS AND TRAVELS AND LIMITATION OF LIABILITY

WHITE COLLAR TOURS AND TRAVELS's role is limited to facilitating the procurement of an Activity service by the User from the Activity Provider. The transaction or the service fulfilment relation is always between the User and the Activity Provider

WHITE COLLAR TOURS AND TRAVELS shall not provide pick up and drop facility for any Activity unless otherwise explicitly mentioned in the confirmation of the reservation.

WHITE COLLAR TOURS AND TRAVELS shall not be liable or responsible for:

·       Any damage or loss, injury, accident, death, breakdown, irregularity, delay/change in schedule, cancellation without cause, inaccurate information, deficiency of service/product, or cancellation due to conditions not under the control of Activity Provider;

·       The health, safety and well-being of the User in the course of availing the Activity or thereafter.

·       Any incidental or ancillary services which is directly purchased by the User from the Activity Provider.

·       Any incorrect information provided by the Activity Provider.

The maximum liability of WHITE COLLAR TOURS AND TRAVELS will be limited to refund of booking amount which was received by WHITE COLLAR TOURS AND TRAVELS for reservation of the Activity.

RESPONSIBILITIES OF THE USERS

The User agrees to comply with the terms and conditions of Activity Provider in addition to WHITE COLLAR TOURS AND TRAVELS's User Agreement and Terms of Service.

The User will be required to present the booking / confirmation voucher issued by WHITE COLLAR TOURS AND TRAVELS in order to avail the Activity.

The User shall further be in possession of valid documents viz. identity proof, address proof, passport in case of Activity booked outside India or any other document as specified by the Activity Provider in order to utilize the Activity booked.

The User may be required to sign a waiver/consent form, safety procedure form, medical declaration or other document before availing the Activity where mandated by the Activity Provider.

The User shall reach out to Activity Provider directly for any concerns subsequent to the confirmation of reservation.

The User should ensure that he qualifies all the eligibility criteria for availing the Activity including but not limited to age limit, weight limit, medical conditions etc. User understands that in case he is found unfit or illegible for the Activity, Activity provider may or may not allow the User to avail the said Activity.

PAYMENTS FOR BOOKINGS, AND CANCELLATIONS

Reservations will be subject to cancellation and refund policies of the Activity Provider which may vary from time to time.

WHITE COLLAR TOURS AND TRAVELS may charge applicable taxes or service charge, convenience fees etc. wherever applicable.

SPECIAL OFFERS AND COUPONS

The following terms will additionally apply to any coupon provided by WHITE COLLAR TOURS AND TRAVELS:

·       WHITE COLLAR TOURS AND TRAVELS responsibility is limited to sharing the coupon with the User subject to receipt of payment from the User.

·       The redemption of coupon is User's responsibility, and providing the service will be the Activity Provider's responsibility.

·       The expiry date of the coupon shall be mentioned on the coupon and the User will not be able the use the coupon subsequent to the date of expiry.

·       The coupon is not redeemable for cash.

·       The coupon once purchased cannot be refunded or cancelled.

VISA SERVICES

ROLE OF WHITE COLLAR TOURS AND TRAVELS AND LIMITATION OF LIABILITY

WHITE COLLAR TOURS AND TRAVELS solely acts as a facilitator for visa processing and is not responsible for grant or rejection of User(s) visa in any manner whatsoever. Issuance of visa is a sole decision of concerned Embassy.

Services offered by WHITE COLLAR TOURS AND TRAVELS should not be considered or construed as Visa advisory or consultancy in any manner as it acts on the instruction of the User.. User understands that he is solely liable to understand the requirement of Visa to undertake his travel booked for the desired destination country/Countries and then instruct WHITE COLLAR TOURS AND TRAVELS accordingly to initiate the Visa application process.

WHITE COLLAR TOURS AND TRAVELS role is limited to informing the User about the documentary requirements for applying for a visa of a specific country or jurisdiction, collecting those documents as provided by the User, and submitting those documents to the respective embassy or high commission. Such requirements for making a visa application (including, but not limited to, documentation, fees and time frames) are provided by WHITE COLLAR TOURS AND TRAVELS on the basis of the information provided by the respective embassy or high-commission. WHITE COLLAR TOURS AND TRAVELS cannot and will not advise on the merit, completeness, or the suitability of the documents, or the likelihood of approval or rejection of the visa being applied for.

WHITE COLLAR TOURS AND TRAVELS may also inform the average time taken for the processing of a visa application by the respective embassy or high commission. However it is User's responsibility to approach WHITE COLLAR TOURS AND TRAVELS for application of Visa in a time bound manner so as to secure Visa prior to the date of departure.

Each country has varying requirements for passport and visa. For instance, certain nations require a minimum number of blank pages in succession or certain minimum balance period of validity of the passport. These requirements are established by those respective countries and are subject to change without notice. While WHITE COLLAR TOURS AND TRAVELS will make best efforts to ensure that its User(s) are given, correct and updated information, there may be instances where the requisite information is not made available to WHITE COLLAR TOURS AND TRAVELS, as a result of which WHITE COLLAR TOURS AND TRAVELS may not be able to provide the same to its customers. In such cases, WHITE COLLAR TOURS AND TRAVELS will not be held responsible for any inaccuracy in such information.

The approval or rejection of visa is at the sole discretion of the respective embassy or the high commission to which the visa application is submitted. WHITE COLLAR TOURS AND TRAVELS has no role in either assessing or processing the visa application. Such approval or rejection depends on a lot of factors, such as the information provided by User, current or previous nationality, place of application of visa, residence, gender, age, profession, recent travel and religion.

On the User's behalf, the concerned consulate, embassy or high commission, may call the User for a face to face interview, at its sole discretion. WHITE COLLAR TOURS AND TRAVELS shall have no role to play in this process. WHITE COLLAR TOURS AND TRAVELS will however inform the User about the date, time and any other requirements as communicated by the concerned Embassy or High Commission for the interview.

WHITE COLLAR TOURS AND TRAVELS may also appoint third party vendors for the visa application process for different countries. Such third-party vendors will be responsible for applying for the visa of customers for the respective countries they have been appointed for.

For visa applications where submission of passports is required, WHITE COLLAR TOURS AND TRAVELS shall take all necessary steps to ensure that the passport is safely delivered to the User. However, WHITE COLLAR TOURS AND TRAVELS shall not be held liable if the passport is lost in transit or misplaced by the logistics service provider.

The countries for which the visa application services are being offered is mentioned in the visa section of the desktop site and the mobile app. The list of countries is subject to change at the discretion of WHITE COLLAR TOURS AND TRAVELS.

WHITE COLLAR TOURS AND TRAVELS shall not be held liable for the acts and omissions of any consulate, embassy, authorities in delaying or not issuing the visa for any reason whatsoever. WHITE COLLAR TOURS AND TRAVELS also cannot be held liable for any incidental cost/expenses in connection thereto incurred by the User. In certain instances, even when a visa is issued, the User may be denied entry as it is the local immigration authorities which have a final say on entry decision.

In addition to Visa certain countries may require additional conditions to be fulfilled. For example an "OK TO BOARD" approval may be required for User(s) travelling to Dubai. User understands that it is the complete discretion of the concerned Airline/ department to grant or reject "ok to board" and WHITE COLLAR TOURS AND TRAVELS has no role to play in this regard. WHITE COLLAR TOURS AND TRAVELS merely acts as a facilitator between the User and the concerned department/ Airlines for application of OK TO BOARD. User(s) are required to provide valid communication details (mobile number/ email id) at the time of applying for the Visa / OK TO BOARD services, as these will be the only point of contact for timely update on the status of User Visa / OK TO BOARD application by WHITE COLLAR TOURS AND TRAVELS.

1.       White Collar Tours And Travels (WCT) aims to process the visa application in the timelines committed to in its promotional materials. WCT will use its best endeavours to minimise any delay or inconvenience caused in this respect. However, WCT does not guarantee time guidelines for any visa application. WCT will not be held responsible should the immigration authorities or any other third party change their rules, regulations, or processing requirements if that change has a direct effect on the timeline for delivery.                                                      

2.       Visa processing times shown on promotional materials are standard/average processing times. Any processing times advised by WCT through its agents or materials should be used as a guide only.                                

3.       WCT will not be held responsible for costs incurred due to a delay in the visa process due to circumstances outside of our control.                                                                                                                                                       

4.       WCT bears no responsibility for costs incurred by an applicant or any secondary applicants while waiting for a visa to be finalised by the immigration authorities. These costs may include but are not limited to cost of flights, rent of accommodation, loss of earnings or any other costs. WCT is not liable for any costs arising from any action or inaction of any immigration authority, embassy or government body associated with the visa process or indeed for the non-provision of service from any third party associated with the visa process or visa delivery; which may result in a visa application or any part in the visa application process being delayed or refused as a result.

5.       For short stay business and tourist visas, WCT may apply for a Double or Multiple entry visa on the client’s behalf, yet the embassy may decide to grant a Single-entry visa. The decision to grant a Single-entry visa remains solely with the embassy and WCT do not have control over this. In this situation, WCT will discount your next visa application with us by the difference in the embassy visa fee.

6.       For any visa, in particular a tourist or business visa, the client should not book a flight ticket unless the embassy has specifically requested evidence of this as a requirement for the visa application.

7.       An embassy may decide to review an application in the destination country rather than at the local embassy. This decision is at the discretion of the embassy, and it is not something that would be known in advance by WCT It may take longer than the standard processing time for such applications to be processed and this is outside the control of WCT reminds you not to book flights until your visa is granted.

8.       WCT advises its clients not to make any travel or hotel bookings, sell any property, or give notice of intent to leave any job until you have your visa. Should you decide to disregard this advice, WCT will not be liable for any associated costs of such action(s).

9.       WCT will always lodge a visa application in the applicants' best interest. We are a private company and we do not have authority to grant a visa of any kind. We cannot guarantee a positive result on a visa application or any assessment or review in arriving at the final result, which is part of the visa process. The final decision on all applications rests with the relevant organization responsible for issuing that result.

10.   WCT cannot influence: any decision made by an immigration authority; any requests for additional information before finalising a visa; any delay by an immigration authority in the issuing of a visa; or a decision to refuse to grant a visa.

11.   The immigration authority/officer has the sole decision on the term of a visa that they grant. This term may be less than the term expected or requested by the client. Similarly, the immigration authority / officer has the sole decision on the activation date that they place on a granted visa. This date may be prior to the date expected or requested by the client. WCT is not responsible for the term of any visa issued or the activation date placed on a visa by an immigration authority even. WCT has no authority or control to change this term/date.

12.   WCT advises its clients on visa options and applies for visa applications on their behalf in good faith based on immigration information made available directly by immigration and embassy departments at the time of lodgement. In the event where immigration laws and/or regulations have been updated by an immigration department, but such updates have not made known to the public at the time of visa lodgement such conflicting information is outside the control of WCT. WCT will not be liable for any visa application being refused or any additional costs arising from such a refusal (including travel costs) should situations of outdated information arise.                                             

13.   Similarly, in the event where immigration advice provided by one immigration officer / consular official conflicts with that of an visa issuing immigration officer at the port of entry, such conflicting information is outside the control of WCT. WCT will not be liable for any visa application being refused or any additional costs arising from such a refusal (including travel costs) should situations of conflicting information between immigration officers arise.                 

14.   WCT will use and rely on information provided by the client in the provision of services to that client. WCT will not independently verify or assume responsibility for the accuracy or completeness of such information.

15.   It is the client's responsibility to provide WCT with all required information and documentation concerning an application. This may include but is not limited to documentation from third parties such as partners, family, employers, sponsors, assessment bodies, educational bodies, etc. If the required documentation does not meet with the requirements of WCT retain the right not to lodge that visa application until it has received all of the required information in order to do so.                             

16.   WCT reserves the right to contact your sponsoring employer should further details be required from the authorities or for confirmation of your application.                                                                                                            

17.   If an immigration authority has incorporated a deadline for the submission of documents to an application, these documents must be provided at the earliest possible time but no later than 48 hours prior to the deadline date.

18.   WCT cannot lodge a visa application until it has complete documentation as outlined in the registration pack and any subsequent documentation requested by WCT from the main applicant.                            

19.   WCT cannot be held responsible for any expense and/or delay arising from incomplete application forms, inaccurate/false or incomplete information provided or inaccurate/false or incomplete supporting documentation.

20.   WCT are not responsible for applications that have become ineligible as a result of changes in Immigration policy at any stage of the immigration process. Any application that is not lodged to the Immigration Authorities may also be affected by changes in Immigration policy.

21.   Certain documentation required for a visa application may be valid for a certain period of time and become invalid thereafter (for example medicals, skills assessment results, police clearance reports). It is the client's responsibility to ensure that the documentation provided to WCT at the time of submitting a visa application are valid and within date.

22.   WCT will provide the relevant medical forms to a client, should health examinations be required. WCT will also provide the client with a list of authorized doctors that are eligible to carry out these medicals. However WCT have no part in the process of carrying out these medicals or providing these medical results to the Immigration Authorities for further processing.

23.   WCT advises applicants not to complete any health examinations (such as Chest X-ray, Medicals, Blood tests, etc) until advised to do so by WCT do not cover the medical costs involved in this process.              

24.   The results of health examinations are valid for 12 months from the date of issue. If the medical results provided to the Immigration Authorities have expired by the time an immigration officer reviews these results for the visa application, the client is responsible for providing up-to-date medicals and paying any associated costs.

25.   If, after registering for the visa application with WCT you wish to withdraw the visa application and that application has not been submitted to the Immigration Authorities, assessment and/or administration fees apply.

26.   Additional cancellation fees apply in cases where you wish to cancel a visa that has been approved.

27.   In the event of loss or damage to any passport or documents received, WCT liability will be limited to the actual value of the passport and documents up to a maximum of INR 2500 per paid application. WCT accepts no liability for consequential loss.

28.   WCT reserves the right to return any passport without the requested visa if the passport or the documents provided do not comply with the immigration requirements or if there is insufficient time to process the visa.

29.   Any visa application request submitted to WCT by a partner or agent on behalf of their client (traveller) will be deemed to be an application submitted to WCTby the partner's / agent's client (traveller) directly to WCT. All terms and conditions listed herein apply to both the partner / agent and the partner's / agent's client (traveller) equally.

30.   If WCT acts as an agent or introduces/refers the customer to ancillary or related products of other businesses, then the customer is bound by the specific Terms and Conditions of that business which may be different to the Terms and Conditions of WCT.                              

31.   WCT is entitled to include additional Terms & Conditions should the need arise. The submission of an application to WCT by web, post, fax, email, constitutes agreement to these Terms & Conditions, including amendments thereto, by the customer.

32.   Correspondence between Immigration and WCT with regards to any visa application is strictly confidential and is not subject to further distribution to third parties (including main applicants).                                       

33.   It is the client's own responsibility to ensure that he familiarizes himself with his visa activation date and that the client enters the country to activate his visa before the visa activation date passes. The client's visa is liable to be cancelled once the visa expiration date passes if the client has not entered before this date. The client bear's all responsibility and liability in such situations.

34.   WCT bears no responsibility or liability for you breaking any existing visa terms and conditions (including overstaying) that you hold or previously held which results in you subsequently becoming illegal in another country. It is your responsibility to ensure that you remain legal at all times while you are in another country.

35.   WCT will not be held responsible for any loss or damage caused by an embassy/consulate issuing an incorrect visa or incorrect details on a visa as this is out of our control.

36.   WCT shall not be held responsible under any circumstance to compensate you for any loss, damage or delay of passports or travel documents by any third party courier/delivery company.

37.   In the event that you want to apply for another visa for a country that you are currently in and the Immigration Authorities require you to be outside of the country at the time of lodgement you need to contact us as soon as you leave the country. Please note that we will process your required visa only once we receive your written confirmation that you are outside of the country. Failure to do so and should you re-enter that country without our team providing you with your visa grant letter/number, may result in additional travel expense which will be your responsibility to cover and not the responsibility of WCT.

38.   Passport cover covers the replacement cost of the passport and where possible the provision of passport replacement documents. Re-imbursement is limited to the fee that the embassy charges for the replacement of the passport to a maximum as set out above. Please note, that the passport cover service is valid only for the duration of the visa.

39.   It is the client's responsibility to make sure he reads the Visa Grant Notification letter. It is very important that he understands and abides by the visa conditions. If he fails to abide by these conditions, the visa may be cancelled and he may be required to leave that country. WCT will not be held responsible for costs incurred as a result of the client not abiding by these conditions.

40.   WCT cannot be held responsible for incorrect details on a visa as it is the client's responsibility to check the received Visa Grant Notification letter and make sure that the passport details on the visa letter appear exactly as they appear on the passport. Please note that failure to do so may result in significant delays/missed flights/additional travel expenses/not being allowed to enter the relevant country. WCT should not be held responsible for costs incurred as a result of not following the above obligation.

41.   A visa may be cancelled at any point in time after the visa grant letter is issued if it is discovered that the information provided to WCT and in turn to the immigration authorities for the purposes of the visa application is deemed to be false and / or misleading information. In the event of a visa being cancelled on such grounds, WCT will bear no responsibility for any costs, grievances, liabilities, or any other outcomes suffered by the clients that results from the cancellation of a visa application arranged through WCT.

RESPONSIBILITIES OF THE USERS

By engaging WHITE COLLAR TOURS AND TRAVELS to facilitate the process of visa application, User authorizes WHITE COLLAR TOURS AND TRAVELS to file necessary visa application along with visa fees, embassy charges on his/ her behalf to concerned embassy.

The User undertakes to provide the documents required for the processing of the visa, promptly to WHITE COLLAR TOURS AND TRAVELS. The User further undertakes that the documents submitted are genuine and further the information provided by the customer is true and correct. WHITE COLLAR TOURS AND TRAVELS shall bear no responsibility to verify the genuineness of the documents or the information provided.

User(s) are also required to provide to WHITE COLLAR TOURS AND TRAVELS all necessary and correct information, to allow WHITE COLLAR TOURS AND TRAVELS to submit application for visa processing. Such information may include, but is not limited to, the User name, address, contact details, holiday destination, and any other information which WHITE COLLAR TOURS AND TRAVELS considers necessary for the purpose of processing the User's visa application.

Once WHITE COLLAR TOURS AND TRAVELS returns passport and documents of a User to him/her, it is their responsibility to check that all requisite visas have been obtained and details mentioned therein are correct and matches to their travel itinerary. User shall also check his/her personal details mentioned on the visa issued.

In case of rejection, if User wishes to reapply/appeal against rejection of the visa, WHITE COLLAR TOURS AND TRAVELS shall do the same strictly pursuant to the instructions of the User. The reapplying/appeal shall be a fresh transaction and the User will be liable to pay the applicable fee for such reapplying/appeal process alongwith service fee to WHITE COLLAR TOURS AND TRAVELS. Unless otherwise applied by the User, WHITE COLLAR TOURS AND TRAVELS will not initiate reapplication of any visa application.

In certain cases, the third-party vendor appointed by WHITE COLLAR TOURS AND TRAVELS may refuse to submit the User's visa application basis the credentials of a User, which may be decided on the basis of the documents submitted by the User. This will be done only in cases where the vendor is of the opinion that there exists a substantial risk of the visa being rejected. In such cases, if certain additional documents are required, the same will be informed to the User, and the application would be submitted only if the such additional documents are submitted and are found to be in order. However, if the application is not submitted by the vendor, the visa fee shall be refunded but the service fee of WHITE COLLAR TOURS AND TRAVELS shall remain nonrefundable.

PAYMENTS AND OTHER CHARGES

WHITE COLLAR TOURS AND TRAVELS will charge the User a service fee towards the cost of providing the services of submitting the application on the User's behalf to concerned embassy. This service fee is in addition to the visa fees, embassy charges and other similar fees by whatever name called or as prescribed by the respective embassy. User shall pay the such service fee to WHITE COLLAR TOURS AND TRAVELS at the time of engaging WHITE COLLAR TOURS AND TRAVELS to provide the visa related services. WHITE COLLAR TOURS AND TRAVELS will not be liable to refund the service fees for any reason what-so-ever, even if the User ultimately decides not to submit the visa application, or if the visa application gets rejected.

In addition to the aforesaid service fees, any charges for logistics, i.e. pick up of documents, collection of passports, courier charges etc. or any other cost incurred by WHITE COLLAR TOURS AND TRAVELS beyond its regular scope of work shall be separately payable to WHITE COLLAR TOURS AND TRAVELS by the User.

Embassy fees, taxes, other charges which are not there under the control of WHITE COLLAR TOURS AND TRAVELS are subject to changes made by embassies or government authorities without prior notice to WHITE COLLAR TOURS AND TRAVELS, and WHITE COLLAR TOURS AND TRAVELS cannot be held liable for this. Such fees, taxes and other charges are not refundable after the visa application is submitted to the respective embassy. The aforesaid is as per the guidelines of the respective embassy, and WHITE COLLAR TOURS AND TRAVELS has no control over the same.

OUTBOUND AND DOMESTIC TOURS

DEFINITIONS

"Independent Contractors" means hotelier or hotel owner, owner of any airlines or shipping company or railway ferryboat owner, coach owner, or any other person or organization which has been selected to render services to the User.

"Outbound Tour" means a tour operated by WHITE COLLAR TOURS AND TRAVELS outside of India and includes, but is not limited to, brochure tours, special tours, packages, cruise, sightseeing, carnival, cosmos, star cruise etc.

"Tour Cost" means total booking cost of all the services booked by the User for his outbound tour.

"Booking Fees" means a non-refundable fee or token money deposited at the time of booking by the User.

"Brochure" means catalogue, leaflet, e-mail or any other document containing the details about the itinerary and activities on an outbound tour.

"Infant" means a person below the age of 2 years and child means a person above the age of 2 years and below the age of 12 years.

ROLE OF WHITE COLLAR TOURS AND TRAVELS AND LIMITATION OF LIABILITY

WHITE COLLAR TOURS AND TRAVELS does not control or operate any airline, shipping company, coach, hotel, transport vehicles, restaurant, kitchen caravan or any other facility or service mentioned in the Brochure.

WHITE COLLAR TOURS AND TRAVELS shall not be responsible for any delay, improper service, standard of service provided by any service provider or any Independent Contractor, or for any injury, death, loss or damage which is caused by the act or default of any hotel, airlines, shipping companies, cruise, coach owners, tour operators who are WHITE COLLAR TOURS AND TRAVELS's independent contractors.

WHITE COLLAR TOURS AND TRAVELS shall not be responsible for any act or actions of co-travelers, co-passengers which may result in injury, damage to the life or limb or property of the User, or which may lead to interference in enjoying or availing the services provided on the outbound tour.

WHITE COLLAR TOURS AND TRAVELS being merely a facilitator , shall not be liable for the following:

·       Personal injury, sickness, accident, death, loss, delay, discomfort, increased expenses, incidental, consequential loss and/or damage or any kind of theft howsoever caused to the User or any person travelling with them.

·       Any act, omission, default of any travel agent or third party or any other person or by any servant or agent employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility or service for the User or for any person traveling with him /her.

·       The temporary or permanent loss of, or damage to, baggage or personal belongings howsoever caused including willful negligence on the part of any person.

·       Any delay made in delivery of the service by the concerned service providers.

·       Failure on the part of airline to accommodate passengers despite having confirmed tickets for any reason whatsoever including overbooking, change of route etc. or failure on part of hotel to allow check-in despite confirmed booking for whatever reason.

·       Any claims of any dispute with the tour manager.

·       Any claim arising due to delay at the airport and if the User has to wait at the airport or at the hotel for check-in due to any technical snag or any other reason not attributable to WHITE COLLAR TOURS AND TRAVELS, WHITE COLLAR TOURS AND TRAVELS shall not be liable for making any arrangements, including but not limited to food or any hotel arrangement in case of such delays.

·       Any damages caused to the User due to reasons beyond the control of WHITE COLLAR TOURS AND TRAVELS.

In no event shall the entire liability of WHITE COLLAR TOURS AND TRAVELS for any claims directly and indirectly arising out of the tour exceed the total booking amount paid by the User.

There can be exceptional circumstances where the service operators like the airlines, hotels, the respective transportation providers or concerns may be unable to honor the confirmed bookings due to various reasons like climatic conditions, labour unrest, insolvency, business exigencies, government decisions, operational and technical issues, route and flight cancellations etc. If WHITE COLLAR TOURS AND TRAVELS is informed in advance of such situations where dishonour of bookings may happen, it will make its best efforts to provide similar alternative to its User or refund the booking amount after reasonable service charges, if supported and refunded by that respective service operators. The User agrees that WHITE COLLAR TOURS AND TRAVELS being an agent for facilitating the booking services shall not be responsible for any such circumstances and the customers have to contact that service provider directly for any further resolutions and refunds. The maximum liability of WHITE COLLAR TOURS AND TRAVELS in such events will be to refund the booking amount subject to receipt from the service providers.

BROCHURE

All information given in the Brochure is based on the information available at the time of publication. WHITE COLLAR TOURS AND TRAVELS reserves the right to change any information contained in the Brochure before or after booking the outbound tour due to any event(s) beyond the control of WHITE COLLAR TOURS AND TRAVELS.

In case WHITE COLLAR TOURS AND TRAVELS becomes aware of any change before the departure for an Outbound Tour, WHITE COLLAR TOURS AND TRAVELS will take all reasonable steps to notify the User before the departure for that Outbound Tour. In the event of WHITE COLLAR TOURS AND TRAVELS becoming aware of the changes post the departure for the Outbound Tour, the WHITE COLLAR TOURS AND TRAVELS tour manager or local representative will inform the User about the change.

The prices quoted in the brochure will be calculated at the rate prevailing at the time of printing of the brochure. WHITE COLLAR TOURS AND TRAVELS reserves the right to amend the prices published in the brochure in case of currency fluctuations, changes in the various gross rates of exchange, and/ or fuel costs, special/ high season charge levied by the suppliers, hike in the airline/ rail charges before the date of departure and to surcharge accordingly. All such increases in price must be paid for in full before the departure by the User.

Apart from the instant Terms of Service and the User Agreement, some specific terms and conditions are mentioned against the respective Outbound Tour in the Website as well as email communication and confirmed booking vouchers. Those terms and conditions also form part of the WHITE COLLAR TOURS AND TRAVELS User Agreement & Terms Of Service and are to be read in consonance with each other.

No claim of the User against any change in the Brochure regarding the Outbound Tour shall be entertained if such changes are due to reasons beyond the control of WHITE COLLAR TOURS AND TRAVELS.

MEALS AND SPECIAL REQUESTS

The menus are pre-set for meals on the Outbound Tour. The nature of meals is clearly indicated in the Brochure. WHITE COLLAR TOURS AND TRAVELS would not entertain a request for a special meal nor guarantees a special diet to the User except to the extent mentioned in the brochure.

WHITE COLLAR TOURS AND TRAVELS reserves the right to change the menu if circumstances necessitate such a change. In the event that the User is not able to avail the meals in the menu for any reason, no claim can be made for the unutilized meal against WHITE COLLAR TOURS AND TRAVELS.

User acknowledges that hotels worldwide serve breakfast at different ( local) time or time as specified in the confirmed booking voucher. User understands that Hotels do not pack or room deliver breakfast. The meal has to be consumed when served. If the User misses breakfast due to any reason, no claim for the same shall be entertained.

WHITE COLLAR TOURS AND TRAVELS may, in its sole discretion, entertain the requests for special meals, room allocations subject to such requests being honored by respective service providers. WHITE COLLAR TOURS AND TRAVELS would take all the necessary steps to ensure that these special requests are honored. However, in the event that such special requests are not honored, WHITE COLLAR TOURS AND TRAVELS would not be liable for any claim in this regard by the User. Extra cost, if any, for special meals or any such special requests have to be borne by the User.

User shall bear the additional charges of any special meal if purchased by him/ her and shall not be entitled to recover the same from WHITE COLLAR TOURS AND TRAVELS.

If the User fails to avail the meal due to the fault of WHITE COLLAR TOURS AND TRAVELS, then WHITE COLLAR TOURS AND TRAVELS's liability is limited to proportionate amount that the User had paid WHITE COLLAR TOURS AND TRAVELS for the meal while booking the outbound tour.

HOTELS IN THE OUTBOUND TOUR

WHITE COLLAR TOURS AND TRAVELS takes all reasonable steps at the time of selecting the hotels that form a part of the Outbound Tour. The selection is based on an internal assessment of the respective hotels and such hotels selected are usually the best in the respective categories. WHITE COLLAR TOURS AND TRAVELS endeavors to provide details of the hotel to the User in advance vide proposed itinerary. However, WHITE COLLAR TOURS AND TRAVELS reserves the right to change hotels before booking, subject to availability or any other reason beyond its control.

Once the User opts for a certain category or star rating of a hotel, later no claim or dispute with regard to the star category or type of the hotel shall be entertained by WHITE COLLAR TOURS AND TRAVELS.

WHITE COLLAR TOURS AND TRAVELS would not be held liable or to make good any inconvenience or discomfort caused to the User due to but not limited to the insufficient services provided at the hotel. WHITE COLLAR TOURS AND TRAVELS acts as a facilitator between the User and the hotel, and would under no circumstances be held responsible for inadequate services provided by the hotel.

The User would be liable to make good any damage(s) caused by any act of him/her or their accompanying guests to the property of the hotel in any manner whatsoever. The extent and the amount of the damage so caused would be determined by the concerned hotel. WHITE COLLAR TOURS AND TRAVELS would not, in any way, intervene in the same.

No request for the change of hotel shall be entertained after the booking is confirmed. If User upgrades the hotel or changes the hotel on his own, he/she agrees to bear the charges incurred for change in the hotel and shall not be entitled to claim it from WHITE COLLAR TOURS AND TRAVELS.

User shall be responsible for his/ her baggage and valuables. WHITE COLLAR TOURS AND TRAVELS shall not be liable for any loss of baggage or theft of User's articles during their stay in the hotels or any time during the tour.

ITINERARY

WHITE COLLAR TOURS AND TRAVELS will provide a proposed itinerary to the User before the booking. Such proposed itinerary shall be subject to changes. The confirmed booking details and hotel vouchers sent to the User before departure and after payment of entire booking amount shall be final.

The Outbound Tour price is subject to increase without any prior notice if this rate substantially changes prior to departure, then the User would be required to pay such incremental tour cost before the departure.

The days and nights of the itinerary are decided as per the availability of hotels and airlines. No claims regarding full utilization of last day or inclusion in the tour shall be valid.

WHITE COLLAR TOURS AND TRAVELS takes all reasonable steps at the time of finalizing the itinerary for the User to ensure that the itinerary is as per the convenience and comfort of the User. However, in the event of a change in the itinerary, WHITE COLLAR TOURS AND TRAVELS would inform the User accordingly before the departure of the User on the Outbound Tour.

Further, in the event of any change beyond the control of WHITE COLLAR TOURS AND TRAVELS in the itinerary of the User post departure for outbound tour, WHITE COLLAR TOURS AND TRAVELS shall inform the User accordingly as and when such a change occurs. WHITE COLLAR TOURS AND TRAVELS shall not be held responsible in any manner whatsoever for any loss that a User might suffer consequent to such a change.

WHITE COLLAR TOURS AND TRAVELS reserves the right to claim any additional expenses on account of delays or changes in the itinerary, caused by any reason whatsoever.

WHITE COLLAR TOURS AND TRAVELS reserves the right to amend, alter, vary or withdraw any particular departure, excursion or substitute a hotel of similar category, or any other aspect of the itinerary, if deemed advisable or necessary.

In the event that the User misses out on any activity on the outbound tour due to delay on his part, WHITE COLLAR TOURS AND TRAVELS would not be held liable to refund the money paid for the same.

WHITE COLLAR TOURS AND TRAVELS will not entertain any change in the itinerary at the request of the User after booking, as such change might disarray the entire tour. However, WHITE COLLAR TOURS AND TRAVELS may, in its sole discretion and subject to availability, provide changes in the itinerary made at the request of the User. User agrees to pay additional cost incurred due to such change/cancellation.

COACH AND SITTING

On the Outbound Tours, coaches are used for transfer purposes including local sightseeing. There are no seat numbers allocated and the Users shall follow instructions of the Tour Manager in this regard.

In case the User is carrying any valuable personal belongings, it is advisable not to leave them behind at the time of disembarking or leaving the coach. WHITE COLLAR TOURS AND TRAVELS will not be held responsible or liable in case of loss of such items from the coach. All baggage and personal effects are at all times and in all circumstances the responsibility of the User.

Any damage caused to the coach during travel as a consequence of the actions of the User shall be payable by the User and WHITE COLLAR TOURS AND TRAVELS would in no manner whatsoever be liable for the same.

The drivers of the coaches are bound by specific rules like maximum driving hours within a day/ during a week, rest period per day/ week etc. Users will have to strictly adhere to the prescribed timetable for the day so that the driver can complete the travel. In the event that any of the sightseeing schedules is missed due to delays caused by the User, the cost of same will not be refunded to the User under any circumstances.

In the event of breakdown of any coach or any vehicle arranged for transportation, WHITE COLLAR TOURS AND TRAVELS will provide an alternative within reasonable time. WHITE COLLAR TOURS AND TRAVELS shall not be liable for any delays occurred due to such breakdown or traffic jam or for any reasons causing delay in the provision of alternative coach or vehicle.

TIPPING

Tipping is customary (unless otherwise stated in the brochure) in all parts of the world for services rendered (e.g. porters, coach drivers, guides etc.). This is however solely at the discretion of the User

Tipping in Europe is something that is expected of anyone providing you a service, for example, local guides, waiters, tour manager, porter etc. However, it is mandatory to tip the coach driver a nominal amount of 2 Euros for Europe and UK and 2 Dollars for USA per person per day for the duration of the tour.

CURRENCY AND TRAVELLER’S CHEQUES

It is recommended that the User carries money partly in local currency (i.e. in the currency of the country where he/she is traveling), partly in traveler's cheques or travel currency card. Traveler's cheque is a safe way to carry money as they are easily cashable for a small service fee charged by the bank and can be replaced if they are stolen or lost, provided you have the traveler's cheque numbers and the counterfoil.

Alternatively, the User can carry a travel currency card, which is by far the safest way to carry foreign currency and provides 24*7 access to cash at relevant ATMs.

ACCOMMODATION FOR CHILD BELOW 12 YEAR OF AGE

If a child below 12 years of age is booked on the outbound tour without paying for a separate bed, then no separate bed will be provided in the hotel.

BOOKINGS THROUGH THIRD PARTY/ TRAVEL AGENTS

In case where a travel agent through whom the Users have booked the Outbound Tour, signs the booking form for and on behalf of the User, it shall be deemed and construed that the Users have duly authorized the said travel agent to sign on their behalf. The signing of the booking form by the travel agent would be binding on the User.

If the User books with a travel agent, the contract is with the User's travel agent and WHITE COLLAR TOURS AND TRAVELS is a supplier to the User's travel agent.

Correct information of the contact details of the User shall be provided at the time of booking. WHITE COLLAR TOURS AND TRAVELS takes no responsibility for any claims arising out of non-receipt of information if the specified contact number is not reachable or does not belong to the User.

WHITE COLLAR TOURS AND TRAVELS takes no liability for any promises made to the User by any other travel agent authorized by the User to make bookings. All products and services are provided as per WHITE COLLAR TOURS AND TRAVELS Broachers or any other document provided to the User at the time of booking the tour.

In case of bookings through other travel agents, refunds (if any) will be made to the travel agent authorized by the User to make bookings.

FORFEITURE OF DEPOSITS

WHITE COLLAR TOURS AND TRAVELS may require the User to pay non-refundable interest-free booking fee at the time of booking the tour.

In the event that the User cancels the booking or fails to adhere to the tour payment schedule as informed in the documentation check list or in the event that the visa of the destination country is not granted or the User is unable to travel on the tour booked due to any personal reason, including medical ground or sickness, cancellation charges will apply as communicated to the User by WHITE COLLAR TOURS AND TRAVELS.

User acknowledges that booking of air tickets, hotels for a tour is done parallel to visa processing to ensure the availability as per the proposed itinerary. In the event of any denial or rejection of visa, WHITE COLLAR TOURS AND TRAVELS shall be entitled to recover any cost incurred in making such bookings by way of deducting cancellation charges as specified hereinabove. User acknowledges that such charges are just and fair and are deducted towards expenses that WHITE COLLAR TOURS AND TRAVELS incurs towards making bookings at the request of the User and consequent cancellation or non-travel by the User.

CANCELLATION DUE TO VISA REJECTION

All the Users traveling on an outbound tour must be in possession of a valid visa (including transit Visa) to enter all the countries in which the Users intends to visit or pass through as a part of the outbound tour.

User(s) whose visas are not granted by the concerned consulates, must intimate WHITE COLLAR TOURS AND TRAVELS immediately about such rejection. WHITE COLLAR TOURS AND TRAVELS will deduct applicable cancellation charges in addition to any additional visa expenses incurred and refund balance amount if any.

In case of rejection, if User wishes to reapply/appeal against rejection of the visa, WHITE COLLAR TOURS AND TRAVELS shall do the same strictly pursuant to the instructions of the User. The reapplying/appeal shall be a fresh transaction and the User will be liable to pay the applicable fee for such reapplying/appeal process along with service fee to WHITE COLLAR TOURS AND TRAVELS. Unless otherwise applied by the User, WHITE COLLAR TOURS AND TRAVELS will not initiate reapplication of any visa application.

CANCELLATION CHARGES

 

If the Outbound Tour is cancelled for any reason what-so-ever, including cases of visa rejection or voluntary cancellation by the User the cancellation charges as mentioned in the brochure or the itinerary will apply. In the absence of any such information, the following cancellation charges will apply:

If Booked Under Non – Refundable Policy: 100% retention.

No refund will be made for any partly unused services- accommodation, missed meal, transportation, cruise portion, sightseeing in case any of these services are not availed by the customer on his / her tour. The Company will not be liable to any passenger for refund, compensation or claim for shortening of tour in relation to tour shown in itinerary or any cancellation, route change or postponement or delay of any airlines/trains due to any reason whatsoever including fog or bad weather and the tickets/package are issued subject to the conditions herein.

Refunds will be processed through online mode in 10-15 days.

PAYMENT OF THE TOUR COST

Payment shall be made as per the payment schedule provided on the brochure, Email or any other documented information as informed at the time of booking.

Payment can be made either online or by way of DD/cheque as specified to the User.

Payment can be made either in INR or any other foreign exchange/currency (as WHITE COLLAR TOURS AND TRAVELS depends on various out bound service providers/ Independent contractors for the purpose of planning the OBT) as specified in the brochure or any other documented information provided at the time of booking.

If any cheque towards the payment is dishonored, WHITE COLLAR TOURS AND TRAVELS, without notice to the User, shall be entitled to cancel the entire booking without any liability and take recourse to appropriate legal remedy.

Final documents and airline tickets will be shared with the User only after the balance payment is made to WHITE COLLAR TOURS AND TRAVELS by the User. PAN Card copy will be required when payments amounting to Rs.25,000/- or above are made by cash.

For purpose of computing the cost of tour or refund, the foreign exchange components of the outbound tour will be calculated at the prevailing day's rate of exchange. And any increase or decrease in the rate of exchange may cause the cost of tour/ refund amount to change and the User shall be bound to bear any such changes.

WHITE COLLAR TOURS AND TRAVELS is not obligated in any circumstance to provide break–up of the invoice for each of the service included in the package.

REFUNDS

WHITE COLLAR TOURS AND TRAVELS is only a facilitator and any refund for any service(s) which are not delivered by the service provider /Independent Contractors or for any reason for which the User is entitled for a refund is subject to WHITE COLLAR TOURS AND TRAVELS receiving the amount from the said service provider. User acknowledges that WHITE COLLAR TOURS AND TRAVELS shall not be held liable for any delay in refund or non-refund of the amount from the respective service provider or Independent Contractors of WHITE COLLAR TOURS AND TRAVELS. In such events the User shall directly approach the service provider for any claims.

In case the User makes any changes in their accommodation while on the Outbound Tour, WHITE COLLAR TOURS AND TRAVELS shall not refund or pay compensation in any manner whatsoever. The User would also be liable to pay any additional sum that is required to be paid consequent to the aforesaid changes made in the accommodation.

In the event of any delay in the refund beyond the period specified herein, the entire liability of WHITE COLLAR TOURS AND TRAVELS shall be refund of the said amount with interest calculated at the applicable bank rate till the date the refund is made.

AMENDMENTS

In the event of WHITE COLLAR TOURS AND TRAVELS amends or alters any tour or holiday after such a tour or holiday has been booked, the User shall have the option to continue with the tour or holiday as amended/ altered, or to accept any alternative tour or holiday which WHITE COLLAR TOURS AND TRAVELS may offer.

In either of these cases above, the User shall not be entitled to nor WHITE COLLAR TOURS AND TRAVELS be liable to the User for any damage, additional expenses or consequential loss suffered by the User. WHITE COLLAR TOURS AND TRAVELS’s liability in such cases shall be only to refund the amount of the cost of the said tour to the User (after deducting the actual expenses incurred by WHITE COLLAR TOURS AND TRAVELS for the booking like visa, insurance premium, and other charges as applicable from case to case, without any interest on the same.

PROMOTION & DISCOUNTS

WHITE COLLAR TOURS AND TRAVELS may, from time to time, launch some promotions and discount offers on the tour package internally or externally through advertisements and some Users in the group tour might receive additional benefits due to entitlement to such promotion and discounts. No claims from Users in the group for such privileges shall lie if they are not entitled for the discounts or eligible under the promotion.

In case of publication of any travel scheme offering any discount or benefit by WHITE COLLAR TOURS AND TRAVELS, WHITE COLLAR TOURS AND TRAVELS shall have the sole right to withdraw such a scheme or discount at any time.

TOUR ARRANGEMENTS & OTHER ACTIVITIES

For tour arrangements like carnival, cosmos, star cruise, amusement parks, museums etc., the terms and conditions specified by such respective entities shall also be applicable.

It shall be the responsibility of the User to reach the place of commencement of the tour and register with the representative of WHITE COLLAR TOURS AND TRAVELS/ tour guide/ tour manager at the appointed place, date and time.

If a User avails pre-tour services or part thereof, or the air tickets (cost of which is included in the main tour cost) but fails to join the group for the main tour at the appointed place, or cancels the tour after using the air tickets or pre-tour arrangements or part thereof, it shall be treated as "no show" and there will be no refund whatsoever for the unutilized pre-tour or main tour services.

WHITE COLLAR TOURS AND TRAVELS cannot be held liable for any hazard to the health, safety and well-being of the User in the course of availing any or all activities including adventure sports, Amusement park & rides, ferry ride, sightseeing or any other activity that may pose a threat of death or injury taken up by the User as a part of the OBT or on his own while on the OBT. Any incidental damage or loss, injury, accident, death etc. suffered in the due course of any such activity shall be at the sole risk and liability of the User attributable to WHITE COLLAR TOURS AND TRAVELS.

MISCELLANEOUS

WHITE COLLAR TOURS AND TRAVELS reserves the right to withdraw tour membership of any User whose behavior is deemed likely to affect the smooth operation of the outbound tour or adversely affect the enjoyment or safety of other passengers. WHITE COLLAR TOURS AND TRAVELS shall not be liable for any damages due to such withdrawal. It is a mandatory condition of booking that the User purchases a holiday insurance. A transfer from one tour to another prior to the departure of the originally booked tour will be treated as a cancellation of the original tour and would attract the cancellation charges as stated hereunder and a fresh booking would have to be made at the prevalent rates.

PERSONAL AND NON-COMMERCIAL USE LIMITATION: Unless otherwise specified, the WHITE COLLAR TOURS AND TRAVELS services are for the User’s personal and non – commercial use. The User may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the WHITE COLLAR TOURS AND TRAVELS website(s) without the express written approval from WHITE COLLAR TOURS & TRAVELS.

INDEMNIFICATION: The User agrees to indemnify, defend and hold harmless WHITE COLLAR TOURS AND TRAVELS and/or its affiliates, their websites and their respective lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by WHITE COLLAR TOURS AND TRAVELS and/or its affiliates, partner websites and their respective lawful successors and assigns that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by the User pursuant to this agreement. The user shall be solely and exclusively liable for any breach of any country specific rules and regulations or general code of conduct and WHITE COLLAR TOURS AND TRAVELS cannot be held responsible for the same.

RIGHT TO REFUSE: WHITE COLLAR TOURS AND TRAVELS at its sole discretion reserves the right to not to accept any customer order without assigning any reason thereof. Any contract to provide any service by WHITE COLLAR TOURS AND TRAVELS is not complete until full money towards the service is received from the customer and accepted by WHITE COLLAR TOURS & TRAVELS. Without prejudice to the other remedies available to WHITE COLLAR TOURS AND TRAVELS under this agreement, the TOS or under applicable law, WHITE COLLAR TOURS AND TRAVELS may limit the user’s activity, or end the user’s listing, warn other users of the user’s actions, immediately temporarily/indefinitely suspend or terminate the user’s registration, and/or refuse to provide the user with access to the website if: The user is in breach of this agreement, the TOS and/or the documents it incorporates by reference; WHITE COLLAR TOURS AND TRAVELS is unable to verify or authenticate any information provided by the user; or WHITE COLLAR TOURS AND TRAVELS believes that the user’s actions may infringe on any third party rights or breach any applicable law or otherwise result in any liability for the user, other users of the website and/or WHITE COLLAR TOURS & TRAVELS.WHITE COLLAR TOURS AND TRAVELS may at any time in its sole discretion reinstate suspended users. Once the user have been indefinitely suspended the user shall not register or attempt to register with WHITE COLLAR TOURS AND TRAVELS or use the website in any manner whatsoever until such time that the user is reinstated by WHITE COLLAR TOURS & TRAVELS. Notwithstanding the foregoing, if the user breaches this agreement, the TOS or the documents it incorporates by reference, WHITE COLLAR TOURS AND TRAVELS reserves the right to recover any amounts due and owing by the user to WHITE COLLAR TOURS AND TRAVELS and/or the service provider and to take strict legal action as WHITE COLLAR TOURS AND TRAVELS deems necessary.

RIGHT TO CANCELLATION BY WHITE COLLAR TOURS AND TRAVELS IN CASE OF INVALID INFROMATION FROM USER: The User expressly undertakes to provide to WHITE COLLAR TOURS AND TRAVELS only correct and valid information while requesting for any services under this agreement, and not to make any misrepresentation of facts at all. Any default on part of the User would vitiate this agreement and shall disentitle the User from availing the services from WHITE COLLAR TOURS & TRAVELS. In case WHITE COLLAR TOURS AND TRAVELS discovers or has reasons to believe at any time during or after receiving a request for services from the User that the request for services is either unauthorized or the information provided by the User or any of them is not correct or that any fact has been misrepresented by him, WHITE COLLAR TOURS AND TRAVELS in its sole discretion shall have the unrestricted right to take any steps against the User(s), including cancellation of the bookings, etc. without any prior intimation to the User. In such an event, WHITE COLLAR TOURS AND TRAVELS shall not be responsible or liable for any loss or damage that may be caused to the User or any of them as a consequence of such cancellation of booking or services. The User unequivocally indemnifies WHITE COLLAR TOURS AND TRAVELS of any such claim or liability and shall not hold WHITE COLLAR TOURS AND TRAVELS responsible for

any loss or damage arising out of measures taken by WHITE COLLAR TOURS AND TRAVELS to safeguard its own interest and that of its genuine customers. This would also include WHITE COLLAR TOURS AND TRAVELS denying/cancelling any bookings on account of suspected fraud transactions.

INTERPRETATION NUMBER AND GENDER: The terms and conditions herein shall apply equally to both the singular and plural form of the terms defined. Whenever the context may require, any pronoun shall include the corresponding masculine, feminine and neuter form. The words “include”, “includes” and “including” shall be deemed to be followed by the phrase “without limitation”. Unless the context otherwise requires, the terms “herein”, “hereof”, “hereto”, „hereunder” and words of similar import refer to this agreement as a whole.

SEVERABILITY: If any provision of this agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect.

HEADINGS: The headings and subheadings herein are included for convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of this agreement, terms and conditions, notices, or the right to use this website by the User contained herein or any other section or pages of WHITE COLLAR TOURS AND TRAVELS Websites or its partner websites or any provision hereof in any manner whatsoever. In the event that any of the terms, conditions, and notices contained herein conflict with the Additional Terms or other terms and guidelines contained within any particular WHITE COLLAR TOURS AND TRAVELS website, then these terms shall control.

RELATIONSHIP: None of the provisions of any agreement, terms and conditions, notices, or the right to use this website by the User contained herein or any other section or pages of WHITE COLLAR TOURS AND TRAVELS Websites or its partner websites, shall be deemed to constitute a partnership between the User and WHITE COLLAR TOURS AND TRAVELS and no party shall have any authority to bind or shall be deemed to be the agent of the other in any way.

UPDATION OF THE INFORMATION BY WHITE COLLAR TOURS & TRAVELS: User acknowledges that WHITE COLLAR TOURS AND TRAVELS provides services with reasonable diligence and care. It endeavors its best to ensure that User does not face any inconvenience. However, at some times, the information, software, products, and services included in or available through the WHITE COLLAR TOURS AND TRAVELS websites or other sales channels and ad materials may include inaccuracies or typographical errors which will be immediately corrected as soon as WHITE COLLAR TOURS AND TRAVELS notices them. Changes are/may be periodically made/added to the information provided such. WHITE COLLAR TOURS AND TRAVELS may make improvements and/or changes in the WHITE COLLAR TOURS AND TRAVELS websites at any time without any notice to the User. Any advice received except through an authorized representative of WHITE COLLAR TOURS AND TRAVELS via the WHITE COLLAR TOURS AND TRAVELS websites should not be relied upon for any decisions.

MODIFICATION OF THESE TERMS OF USE: WHITE COLLAR TOURS AND TRAVELS reserves the right to change the terms, conditions, and notices under which the WHITE COLLAR TOURS AND TRAVELS websites are offered, including but not limited to the charges. The User is responsible for regularly reviewing these terms and conditions.

JURISDICTION: WHITE COLLAR TOURS AND TRAVELS hereby expressly disclaims any implied warranties imputed by the laws of any jurisdiction or country other than those where it is operating its offices. WHITE COLLAR TOURS AND TRAVELS considers itself and intends to be subject to the jurisdiction only of the courts of New Delhi, India.

RESPONSIBILITIES OF USER VIS-A-VIS THE AGREEMENT: The User expressly agrees that use of the services is at their sole risk. To the extent WHITE COLLAR TOURS AND TRAVELS acts only as a booking agent on behalf of third party service providers, it shall not have any liability whatsoever for any aspect of the standards of services provided by the service providers. In no circumstances shall WHITE COLLAR TOURS AND TRAVELS be liable for the services provided by the service provider. The services are provided on an “as is” and “as available” basis. Customer acknowledges that Hotel star ratings are indicative only. Ratings are basis the representation made by the Hotel to WHITE COLLAR TOURS & TRAVELS, customer feedback and basis ratings on Trip Advisor or similar websites. Ratings are indicator of their services and products quality, which may vary from city to city. For any dispute vis-a-vis the ratings or service of the Hotels, customer must approach the Hotels directly. WHITE COLLAR TOURS AND TRAVELS may change the features or functionality of the services at any time, in their sole discretion, without notice. WHITE COLLAR TOURS AND TRAVELS expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. No advice or information, whether oral or written, which the User obtains from WHITE COLLAR TOURS AND TRAVELS or through the services shall create any warranty not expressly made herein or in the terms and conditions of the services. If the User does not agree with any of the terms above, they are advised not to read the material on any of the WHITE COLLAR TOURS AND TRAVELS pages or otherwise use any of the contents, pages, information or any other material provided by WHITE COLLAR TOURS & TRAVELS. The sole and exclusive remedy of the User in case of disagreement, in whole or in part, of the user agreement, is to discontinue using the services after notifying WHITE COLLAR TOURS AND TRAVELS in writing.

TCS COMPLIANCE

TCS on Overseas tour packages:

'Overseas tour package' means any tour package which offers visit to a country or countries or territory or territories outside India and includes expenses for travel or hotel stay or boarding or lodging or any other expenditure of similar nature or in relation thereto.

‘Specified Person’ means a person defined as per provisions of Section 206CCA(3) of Income Tax Act, 1961.

The User is liable to pay Tax collected at source (TCS) on booking of an ‘Overseas tour package’ at an appropriate rate over and above the price charged for such package in compliance with the provisions of Section 206C (1G)(b) of the Income Tax Act, 1961. WHITE COLLAR TOURS AND TRAVELS will deposit the TCS amount so collected with the Government and issue appropriate document/certificate to the User in compliance with aforesaid provision.

The User is required to provide a valid PAN of User/Traveler(s) at the time of booking an overseas tour package with WHITE COLLAR TOURS AND TRAVELS. The User understands and agrees that WHITE COLLAR TOURS AND TRAVELS, at the time of booking or at a later stage, will validate the PAN provided by the User to check compliance of provisions of Section 206CC of Income Tax Act. The User agree that in case the PAN is found to be invalid, or it does not belong to User/traveler(s), WHITE COLLAR TOURS AND TRAVELS has an obligation to cancel the booking in compliance with the law and process the refund as per the cancellation policy applicable to said booking.

The User further understand and agrees that WHITE COLLAR TOURS AND TRAVELS would also, at the time of booking or at a later stage, validate User/travellers PAN as per the provisions of Section 206CCA of Income Tax Act and if on validation the User qualifies as a ‘Specified person’, the User agrees to pay TCS to WHITE COLLAR TOURS AND TRAVELS at such higher rate as may be applicable under section 206CCA. The User agrees to pay the additional TCS amount to WHITE COLLAR TOURS AND TRAVELS where, as a result of validation under section 206CCA, the TCS collected at the time of booking fall short of the applicable rate of TCS. If User fails or disagree to pay the additional TCS, WHITE COLLAR TOURS AND TRAVELS has the right to cancel the booking and process appropriate refund as per the cancellation policy applicable to such booking.

COMPLIANCE OF LIBERALIZED REMITTANCE SCHEME (LRS)

The RBI mandates collection of PAN details for all transactions made under Liberalized Remittance Scheme (LRS)which include any international booking made on the Website or through Sales Channels. The User warrants and confirms that PAN details of the User/traveller’s will be shared by the User on or before the cut-off date prescribed by WHITE COLLAR TOURS AND TRAVELS either at the time of booking or after the booking is made. In case the traveller’s is a minor, WHITE COLLAR TOURS AND TRAVELS will require PAN details of the parent/guardian of such minor. The User further confirms that non-compliance of this requirement may result in cancellation of the booking.

The User warrants and confirms that the total amount of foreign exchange purchased or remitted during the current financial year, through all sources in India (including the current transaction) falls within the permissible limit prescribed by the RBI. In case the limit gets breached before the actual remittance request is approved by the AD Bank, WHITE COLLAR TOURS AND TRAVELS has an obligation to cancel the booking in compliance with the law and process refund as per cancellation policy applicable to said booking. The User further confirms that foreign exchange, if any, purchased by User for the purpose of international travel under the current booking will be utilized for the purpose indicated above.

The User authorizes WHITE COLLAR TOURS AND TRAVELS to retrieve User’s/ traveller’s (in case booking on someone’s behalf) PAN details from Users profile, previous bookings or share User/traveller’s data with third party(ies) for collecting or verifying PAN details solely for the purposes mentioned in this Agreement.

The User understands WHITE COLLAR TOURS AND TRAVELS does not collect User’s PAN details without consent. If the User wishes to opt of providing the same or wishes to delete it if already provided, the User may do so by accessing the profile information through the Desktop.

The User authorizes WHITE COLLAR TOURS AND TRAVELS to share User/traveller’s data with third party(ies) for collecting or verifying PAN details of User/traveller’s.

Cashback: The WHITE COLLAR TOURS AND TRAVELS cash back promotion is valid on tour package purchases made on WHITE COLLAR TOURS & TRAVELS, if the customer is unhappy/unsatisfied with the services that we provide, subject to terms and conditions. Claims must be submitted by the end user customer only. Resellers/Transferors may not submit claims on behalf of their customers. Cash back is offered for the particular service which the customer have complaints about and cash back will be offered based on terms and conditions. Customers who have received special pricing from WHITE COLLAR TOURS AND TRAVELS are not eligible for this promotion at any point, WHITE COLLAR TOURS AND TRAVELS will not be liable to pay more the value of the whole package price or Rs. 5,000 or which eve is lower.

WHITE COLLAR TOURS AND TRAVELS reserves the right to disqualify incomplete, altered, or illegible claims.

WHITE COLLAR TOURS AND TRAVELS reserves the right to amend or cancel the terms of any offer without notice.
